DISPENSARIES FAQ

Yes, cannabis is legal for both recreational and medical use in the state of New Jersey. Medical cannabis use was approved in 2010 to qualifying patients, and medical access was further expanded in 2018. Recreational use for adults 21 years and older was legalized on February 22, 2021, and commercial sales began on April 21, 2022. Cannabis delivery is allowed in the state of New Jersey.

Adult residents of New Jersey 21 years and older can purchase up to one ounce of flower or its equivalent in other forms, and possess up to one ounce. Adult residents of New Jersey over the age of 21 can also gift another adult resident of New Jersey up to one ounce of cannabis. Out-of-state residents 21 years and older can purchase cannabis products with the proper ID.

Medical patients with qualifying conditions (list can be found on the New Jersey Cannabis Regulatory Commission website) have been able to access medicinal cannabis since 2018 when outgoing Governor Jon Corzine signed the limited medical marijuana law on his last day in office. The program’s implementation was delayed under incoming Governor Chris Christie, a staunch marijuana prohibitionist, but was further expanded by the state’s current governor, Phil Murphy. While cannabis is now recreationally legal in the state, patients can choose to apply for a medical card, and can then purchase up to 3 ounces of cannabis in a 30-day period. No taxes will be collected on medical cannabis products.

New Jersey will permit indoor and outdoor consumption lounges for both medical patients and adult-use customers. Otherwise, nearly all public consumption of cannabis products is prohibited. Driving under the influence of cannabis is illegal.
